Version of 22 October 2026. This translation is provided for information only: only the French version is legally binding.
1. Purpose and definitions
These general terms and conditions of sale (the “Terms”) set out the conditions applicable to the translation services provided by Pierre Souchar (the “Provider”): sworn (certified) French-Spanish translations, audiovisual translations (subtitling, transcription, adaptation) and technical translations (the “Services”), on behalf of any natural or legal person (the “Client”).
For the purposes of these Terms, a “Consumer” is any natural person acting for purposes outside their commercial, industrial, craft, professional or agricultural activity, and a “Business” is any natural or legal person, public or private, acting for purposes within the scope of their activity, including when acting in the name or on behalf of another business. Where the Client orders a Service for a third party (the “End Client”), the latter is not a party to the contract; the Client shall inform them of these Terms and remains solely responsible towards them.

3. Application and enforceability
These Terms can be consulted at any time on this website and are sent with every quote. Any order implies full and unreserved acceptance of these Terms, to the exclusion of any other document of the Client (purchasing conditions, purchase orders, etc.), unless expressly agreed in writing by the Provider. The contract consists of these Terms and the accepted quote, which constitutes its special conditions.
These Terms are drafted in French; they may be translated into other languages for information purposes, but only the French version is legally binding. The fact that the Provider does not, at any given time, rely on any of these Terms shall not be construed as a waiver of the right to rely on it at a later date.
4. Quotes and orders
Each Service is subject to a free quote, drawn up on the basis of the documents to be translated or the complete information provided by the Client (website form, email or messaging service), who is responsible for its accuracy. The quote specifies, in particular: the subject of the Service, the number of pages or words, the source language and the target language (and, where applicable, its variant), the price and how it is calculated, any surcharges (urgency, specific terminology research, specific layout), the turnaround time and delivery method, and its period of validity.
The quote is valid for 30 days; if it has not been accepted by the end of this period, it lapses. The order becomes firm when the Client returns the quote without any modification, either signed with the words “bon pour accord” (approved) or accepted by email, and, where applicable, once the deposit provided for in Article 6 has been received. Failing acceptance, the Provider is under no obligation to begin the Service.
If documents are added or modified after the quote has been drawn up, if the quote was drawn up without the complete documents, or if the schedule is changed, the Provider may send an additional or amended quote; failing the Client’s agreement, the Provider may decline to begin or may interrupt the Service.
For a regular Business Client who has accepted these Terms, an order may be placed by a simple exchange of emails; it is then invoiced at the Provider’s usual rate or at the rate agreed in that exchange. Any discounts granted apply only to the Service concerned and create no entitlement for subsequent orders.
5. Prices
Prices are stated in euros. VAT not applicable, Article 293 B of the French General Tax Code (Code général des impôts).
The rate for sworn translation is €35 per page of the original document, unless otherwise stated in the quote. Audiovisual and technical translations are invoiced according to the quote (per page, per word, per minute, at a flat rate or on a time basis). Costs incurred for the Service, in particular postage (tracked or registered letter), are specified in the quote and invoiced in addition.
6. Payment
For any order exceeding €100, a 50% deposit is required when the order is placed; work on the Service begins once it has been received. For Consumers, the balance is payable on delivery. For Businesses, invoices are payable within 30 days of their date of issue, unless otherwise specified in the quote.
Accepted payment methods: bank transfer, Wero transfer, cheque, and cash within the legal limit. Invoices are issued net, with no discount for early payment. For payments made from abroad, all bank and currency exchange charges are borne by the Client.
The translation delivered remains the property of the Provider until the price has been paid in full. In the event of late payment, the Provider may suspend any orders in progress and the handover of the signed original. No payment may be withheld or set off without the Provider’s prior written consent.
For Business Clients, any late payment automatically incurs, without prior formal notice, penalties calculated at the rate applied by the European Central Bank to its most recent refinancing operation plus 10 percentage points, as well as a fixed indemnity of €40 for recovery costs (Articles L441-10 and D441-5 of the French Commercial Code).
7. Right of withdrawal (Consumer Clients)
Where the contract is concluded at a distance (email, form or messaging service) or off-premises with a Consumer, the Consumer has fourteen days from the conclusion of the contract to exercise their right of withdrawal, without having to give reasons or bear any costs other than those set out below (Articles L221-18 et seq. of the French Consumer Code). To do so, they simply need to send an unequivocal statement, for example using the form in the appendix, by email or by post.
A Consumer who wishes the translation to begin before the end of this period must expressly request it. If they subsequently withdraw, they shall pay an amount proportionate to the total price, corresponding to the work carried out until they communicated their decision (Article L221-25). The right of withdrawal may no longer be exercised once the Service has been fully performed before the end of the withdrawal period, with the Consumer’s prior express consent and their acknowledgement that they will lose this right once the Service has been fully performed (Article L221-28, 1°).
In the event of a valid withdrawal, any sums paid are refunded within fourteen days, using the same means of payment, less, where applicable, the proportionate amount mentioned above. The right of withdrawal does not apply to Business Clients.
8. Cancellation of an order
Any cancellation must be notified in writing. If a Business Client cancels an order that is in progress, whatever the reason, the work already carried out is invoiced at 100% and the work remaining at 50%. If a Consumer Client cancels an order other than by exercising the right of withdrawal, only the work already carried out is invoiced.
9. Turnaround times and delivery
The turnaround time stated in the quote runs from the firm order and the receipt of all the necessary documents, legible and complete. It is set according to the Provider’s workload. For Business Clients, turnaround times are indicative and failure to meet them shall not give rise to any penalty or compensation.
The sworn translation is delivered as an original paper document, signed and bearing the seal of the expert translator, together with a copy of the source document. It is handed over in person in Brest or sent by post to the address provided by the Client. A digital copy (PDF) may be sent by email for information purposes; only the signed paper version has the value of a sworn translation, unless the receiving authority accepts another format. Other translations are delivered by email, in the format of the source document or in any other agreed format; any other delivery method or format may be invoiced in addition.
The Service is deemed to have been performed when the translation is sent or handed over to the Client, or to the End Client at the Client’s request; any postal or electronic acknowledgement of receipt constitutes proof of delivery.
10. Corrections and complaints
The Client has 10 working days from receipt of the translation to report in writing, precisely, any error or non-conformity. Errors attributable to the Provider are corrected free of charge and as quickly as possible. After this period, the Service is deemed to have been accepted; any subsequent correction or proofreading is invoiced at the current rate.
The translation may contain stylistic choices or wording specific to the Provider that do not alter the meaning of the text: these do not constitute a non-conformity and do not justify non-payment. Where a translation is intended for publication, the Client shall send the printer’s proof to the Provider for proofreading before printing.
11. Provider’s obligations
The Provider undertakes to produce a faithful and careful translation, in accordance with professional practice and, for sworn translations, with the requirements attaching to the status of court-appointed expert. The Provider takes into account the material supplied by the Client (glossaries, terminology, plans, abbreviations, etc.). The Provider cannot be held liable for inconsistencies or ambiguities in the source document.
12. Client’s obligations
The Client shall provide all the documents to be translated, complete and legible, together with any information needed to understand them: required terminology, official spelling of proper names and place names, preferred transliterations, and the country and authority for which the translation is intended. Failing this, the Provider cannot be held liable for any non-conformity or delay.
It is the Client’s responsibility to check with the receiving authority (town hall, prefecture, consulate, university, notary, etc.) its specific requirements: sworn translation in France or in another country, apostille or legalisation of the source document or of the translator’s signature, presentation of the original. These formalities are not part of the Service, unless otherwise stated in the quote, and the Provider cannot be held liable if a translation is refused where these requirements were not communicated before the order was placed. The translation is made from the document provided by the Client; where it is made from a copy, it may state this.
13. Confidentiality and professional secrecy
The Provider is bound by professional secrecy and strict confidentiality regarding the documents and information that come to their knowledge before, during and after the Service. These are used solely to perform the Service and are not disclosed to any third party, except where required by law. Original documents are returned to the Client upon simple request. The Provider complies with the SFT code of ethics.
The Provider cannot be held liable for any interception or misappropriation of information during its transmission, in particular over the Internet. It is the Client’s responsibility to specify, at the latest when placing the order, the transfer method they wish to be used for sensitive information.
14. Personal data
The Client’s personal data and the personal data contained in the documents to be translated are processed in accordance with the General Data Protection Regulation (GDPR), for the performance of the contract and compliance with the Provider’s legal obligations, in particular tax obligations, as described in the website’s privacy policy (purposes, retention periods, rights of access, rectification, restriction and objection).
15. Liability
The Provider is bound by an obligation of means (best efforts). Towards Business Clients, the Provider’s liability is limited to direct damage resulting from a proven fault, up to the amount of the Service concerned; indirect damage (loss of business, loss of opportunity, damage to reputation, etc.) is excluded. Towards Consumers, the Provider’s liability is determined under the conditions laid down by law.
The Provider cannot be held liable where non-performance or defective performance is due to the Client, to the unforeseeable and insurmountable act of a third party (for example the End Client or the postal services) or to an event of force majeure.
16. Intellectual property
The Client warrants that they have the right to have the documents entrusted to the Provider translated (as the author or with the written authorisation of the rights holder) and shall indemnify the Provider against any claim in this respect.
The translation is a work protected by the French Intellectual Property Code, of which the Provider is the author; the Provider’s tools and resources (translation memories, glossaries, etc.) remain the Provider’s exclusive property. Once payment has been made in full, the Client may freely use the translation for the purpose specified when the order was placed, in particular submitting a sworn translation to the receiving authority. Any other use, in particular the publication or distribution of an audiovisual or technical translation, is subject to the Provider’s agreement, under the conditions set out in the quote; the Provider may then request to be credited by name.
The Client shall not use the translation, or any element belonging to the Provider, to feed or train machine translation software or an artificial intelligence system.
Unless the Client objects, the Provider may mention the name of a Business Client among their references, without ever disclosing the content of the documents translated.
17. Force majeure
Neither party may be held liable for failure to perform its obligations in the event of force majeure within the meaning of Article 1218 of the French Civil Code. The Provider shall then inform the Client as soon as possible and the parties shall seek a solution together (extension of the deadline or cancellation, at no cost, of the part not yet performed).
18. Evidence
The parties acknowledge that emails, copies and electronic records have the same evidential value as an original written document, in particular for the acceptance of the quote and for delivery.
19. Consumer mediation (membership being validated)
In the event of a dispute, the Consumer Client shall first send a written complaint to the Provider. If no satisfactory response is received within one month, the Consumer may refer the matter, free of charge, to the consumer mediator to which the Provider belongs (Articles L611-1 et seq. of the French Consumer Code), in accordance with the mediator’s procedures:
SAS Médiation Solution – sasmediationsolution-conso.fr – +33 4 82 53 93 06
The mediator may not examine the dispute, in particular, where the Consumer cannot show that they first submitted a written complaint to the Provider, where the request is manifestly unfounded or abusive, where the dispute has already been examined or is being examined by another mediator or by a court, where the request is submitted more than one year after the written complaint, or where the dispute does not fall within the mediator’s remit (Article L612-2).
20. Governing law and jurisdiction
These Terms are governed by French law. In the event of a dispute with a Business Client, the parties shall first seek an amicable solution within 30 days of written notification of the dispute; failing this, the dispute shall be brought before the Judicial Court (tribunal judiciaire) of Brest, which is granted exclusive jurisdiction, unless otherwise provided by mandatory rules. The Consumer Client may bring proceedings, at their choice, before the court of the place where they resided when the contract was concluded or where the harmful event occurred, or before any other court having jurisdiction under the law.
